JUDGMENT / ORDER

Petition filed under Section 438 of Cr.P.C. 2. Petitioner is the sole accused in Crime No.1168 of 2014 of the Chevayoor Police station registered for the offences under Sec.7 read with Sec.8 and 9F and 10 of Protection of Children from Sexual Offences Act, 2012. The allegation is that, he made sexual advances towards a minor girl and caught hold of her by her hand with sexual intent and made sexually coloured remarks.
3. Learned counsel for the petitioner submits that the allegations are false.
4. Heard.
5. On the statement of the victim, the Police had registered another case, the number being Crime No.893 of 2014 of Chevayoor Police station. The allegation in that case was that the petitioner sexually assaulted another girl. That was settled and the proceedings were quashed on 17.09.2014 by Annexure C order of this Court. The complaint in this case was given on 06.10.2014.
5. The learned counsel for the petitioner submits that the statement is false and it was given with the intention of harassing him. The alleged incident happened about 7 months before the complaint. The age of the child on the date of occurrence is said to be 17 years.
6. It appears that there are some suspicious circumstances in the case. Having regard to all these facts, I am inclined to grant anticipatory bail to the petitioner.
In the result this application is allowed.
(i) The petitioner shall be released on bail after interrogation on his executing bond for Rs.25,000/- (Rupees twenty five thousand only) with two solvent sureties each for the like sum if he is arrested by the Police in connection with this case.
(ii) The petitioner shall appear before the investigating officer between 10.30 a.m. and 11.30 a.m. on every 1st and 3rd Fridays for three months or till final report is filed, whichever is earlier.
(iii) The petitioner shall not get himself involved in any other case while he is on bail.
(iv) If the petitioner violates any of the above conditions, the Court of enquiry/trial is empowered to cancel the bail in accordance with the law.
