This petition has been filed to call for the records relating to the proceedings of the respondent bearing letter No.,s-kp-bgh-eh/tyR-nfh/fl;L-vz;/327-2003 dated 05.03.2004 and quash the same and consequently forbear the respondent from in any way levying or collecting charges under Tariff V in respect of the petitioner's service connection No. SC 202 situate in Kaikativalasu Erode District.
2. When the matter is taken up for the hearing, it is represented by the learned counsel for the respondent that pursuant to the demand notice, the petitioner has paid the amount of Rs.38,725/-(Rupees thirty eight thousand seven hundred twenty five only). The learned counsel for the respondent has filed counter affidavit to that effect and the relevant paragraphs (9) and (10) are extracted below: "9. I Respectfully submit that as per the demand notice the petitioner paid Rs.38,725/-(Rupees thirty eight thousand seven hundred twenty five only) (CC Charges-35673,BPSC-Rs,535/-05/2004 CC-140/-BPSC-2/-, 07/2004-03/2006 CC-1540/-DC,RC-60/-testing fee-75/-Total-Rs.38,725) vide PR No. 739674/ dt 17.04.2006, PCB No.031232/ dated 17.04.2006.
10. I Respectfully submit that after filing the writ petition the petitioner was paid all charges to the TANGEDCO and petitioner's grievance was solved."
3. As the entire amount has been paid to the Electricity Board, nothing survives for consideration in this writ petition. The writ petition is disposed of accordingly. No costs. Consequently, connected miscellaneous petition is closed.
