Both the learned counsel for the parties submit that the suit filed by respondent No.2 - original complainant came to be dismissed by judgment and order dated 14.5.2010 by Civil Court, Surendranagar and the respondent No.2 - original complainant has challenged the said judgment and decree by preferring the appeal before the District Court, Surendranagar and the same is pending. It is, therefore, requested that the proceedings of Criminal Case No.1931 of 2008, which is pending in the Court of learned Chief Judicial Magistrate, Surendranagar, may be stayed till the final outcome of the civil appeal.
In the above view of the matter, the Criminal Case No.1931 of 2008, is stayed, till the final outcome of the civil appeal pending in District Court, Surendranagar.
The instant matter to be listed by the Registry after either both or any of the parties to this proceedings presents copy of the order of the Appellate Court.
