JUDGMENT / ORDER

The petitioner was awarded with the work of re- construction of side drains and paving of interlocking cement concrete blocks at Ayoor junction in MC Road. It seems that the petitioner's work has been terminated without risk and cost. This fact is not disputed by the learned Government Pleader. The only grievance of the petitioner is that he is entitled for the bill for the work already executed by him and it may be measured and the bill may be disbursed to him. It is submitted by the learned Govt.Pleader that the petitioner has not satisfactorily completed any item of work and it is not possible to issue any certificate for payment to the petitioner. The fact remains that the petitioner's contract has been terminated without risk and cost as stated above. In view of the above, there shall be a direction to the second respondent to WP(C).No.16495/2014-J.
2 measure the work executed by the petitioner, if any, as per the agreement and draw up the bill for the work executed by the petitioner in accordance with the agreement. Needful shall be done by the second respondent within a period of two months.
Writ petition is disposed of as above.
