Piyushkumar vs State

High Court Of Gujarat|29 June, 2012

JUDGMENT / ORDER

1. This petition has been filed seeking issuance of appropriate directions to the respondents to grant Family Pension to the petitioner w.e.f. the year 2001 with interest.
2. The facts in brief are that the father of the petitioner passed away in the year 1997. Until his death, the deceased father was getting regular pension and after his death, the widow was getting family pension. In the year 2001, when the petitioner attained the age of 34 years, he lost his eye-sight. In the year 2009, the mother of the petitioner passed away. Thereafter, the petitioner made representation to the respondents requesting to grant him family pension. However, the same was not entertained. Hence, this petition.
3. Heard learned counsel the respective parties. In support of his case, the petitioner has placed reliance on Form-I (Annexure-D) issued by the State Government, which is the application to be submitted to the concerned Department for the grant of family pension and more particularly, on Clause-2 therein. However, in my opinion, the same would not be of any help to the petitioner since the petitioner became blind at the age of 34 and not prior to attaining the age of 25 years. The petitioner had acquired disability in the year 2001 when he had already crossed 25 years of age. If the disability had been acquired before 25 years of age, then the petitioner would have become eligible. Hence, the petitioner shall not be eligible to get family pension. In view of the same, the petition is devoid of any merits and is, accordingly, rejected.
