1. The present applicant is under-trial prisoner. He has approached this Court through his father seeking temporary bail for a period of 30 days in connection with C.R. No.I-2/2009 registered with Rander Police Station, Surat. He is in jail since 05th January,2009 in connection with offences under Sections 406, 420, 463, 467, 468, 471, 120B and 114 of IPC. Learned advocate for the applicant states that he was released once on temporary bail and surrendered in time. This time temporary bail is prayed so as to see that he is able to attend to his ailing wife who is advised Hysterectomy operation, which is scheduled on 20.05.2012.
2. RULE.
Mr.H.K.Patel, learned Additional Public Prosecutor waives service of Rule on behalf of the respondent-State.
3. For the contents of the application, the same is allowed. The applicant-under-trial prisoner is ordered to be released on temporary bail for a period of 30 days from the date of his release, on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand Only) before the Jail authorities and on conditions that:-
he shall mark his presence at the nearest Police Station every alternate day.
in the event he is required to leave local limits of Surat, he shall intimate about the same to the police authorities.
4. The applicant shall surrender to the Jail authorities on expiry of the temporary bail period.
5. Rule is made absolute.
Direct service permitted today.
