Heard Sri P.K. Bhardwaj, learned counsel for the applicant, Sri Ashish Pandey, learned A.G.A. for the State and perused the record.
The first bail application of the applicant was rejected by this Court on 28.4.2015. This is the second bail application on behalf of the applicant.
The new ground argued by learned counsel for the applicant is that all the witnesses of fact have turned hostile before the trial court and the applicant is in jail since 1.7.2014 and trial has not yet been concluded.
Learned AGA opposed the prayer for bail and submitted that trial is in progress.
Without expressing any opinion on the merits of the case and considering the submissions advanced, I find that no good ground is made out for enlarging the applicant on bail.
The bail application of the applicant Piyush, involved in case crime no.176 of 2014, S.T. No.836 of 2014, u/s 147, 148, 149, 302, 120-B IPC, P.S.
Naraura, district Bulandshahar is, accordingly, rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within a period of four months from the date of production of certified copy of this order before the trial court if there is no legal impediment.
The applicant is directed to produce the certified copy of this order before the trial court for it's compliance.
