Heard Sri Pradip Narain Singh, learned counsel for the applicants, Sri Manvendra Singh, Advocate has filed his Vakalatnama on behalf of opposite party no.2 along with short counter affidavit, learned AGA for the State and perused the record.
Present application has been filed by the applicant with the prayer to quash the entire proceedings of criminal case no.3883 of 2017 (State Vs. Piyush and others) and charge sheet dated 14.4.2017 including cognizance order dated 30.8.2017 arising out of case crime no.427 of 2016, under Sections 498A, 323, 504, 506, 406 IPC and 3/4 of D.P. Act, P.S. Mahila Thana, District Ghaziabad.
Learned counsels for both the parties have stated that with the intervention of the relatives of both the parties have decided to resolve their dispute trough compromise. The dispute being matrimonial one and as the parties have settled all the differences through compromise which finds support from the compromise application and receipts of amount of Rs. Two lakhs as one time settlement by the opposite party no.2, I deem it fit to quash the proceedings on the basis of compromise as no useful purpose would be served by keeping the proceeding pending.
I have perused the allegations made in the first information report and the averments made in the joint compromise.
In view of law laid by Hon'ble Apex Court in the case of Gian Singh vs State Of Punjab and another in Special Leave Petition (Crl) No.8989 of 2010 decided on 24 September, 2012, the aforesaid proceeding is hereby quashed.
Criminal Misc. Application under Section 482 Cr.P.C., accordingly stands allowed.
A copy of this order be certified to the lower court forthwith.
