JUDGMENT / ORDER

Heard learned counsel for the applicant, Sri Anil Kumar Pathak has filed memo of his appearance on behalf of opposite party no.2 and learned A.G.A. for the State.
The proceedings in Criminal Case No.3952 of 2010 (State of U.P. Vs. Piyush Nigam) under sections 467, 468, 471, 323, 504, 506 IPC of P.S. Nazirabad, District Kanpur Nagar is challenged.
Submission is that the proceedings under Section 16(1)(B) of U.P. Act No.13 of 1972, under Section 133 Cr.P.C. as well as the eviction civil suit is pending between the parties. The instant proceedings have been initiated only as means of harassment and somehow vindicate long stand grudge the learned counsel for the applicant has appeared before the Court on behalf of opposite party no.2 has disputed each and every argument.
However, in view of the existing facts and circumstances counsel for the opposite party no.2 is allowed three weeks' time to file counter affidavit. Rejoinder affidavit may be filed within two weeks thereafter.
List for admission immediately on the expiry of the aforesaid period.
Till the next day of listing, the proceedings of Criminal Case No.3952 of 2010 (State of U.P. Vs. Piyush Nigam) under Sections 467, 468, 471, 323, 504, 506 IPC of P.S. Nazirabad, District Kanpur Nagar shall remain stayed. Order Date :- 17.6.2010 P
