THE HON’BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION NO.30187 OF 2014 ORDER:
Heard the learned counsel appearing for the petitioner and the learned Standing Counsel for LIC., appearing for the respondents 1 and 2.
This writ petition is filed, seeking a writ of certiorari declaring that the delaying tactics of the respondents in filing the reply statements in L.C.I.D.No.2 of 2014 on the file of the Central Government Industrial Tribinal-cum- Labour Court, Hyderabad is in violation of Rule 10 B (2) and (11) of the Industrial Disputes (Central) Rules 1957 and is only to circumvent the speedy justice to the petitioner, defeating the purpose of the Industrial Disputes Act of 1947, thereby, respondents forfeited their right to file the reply statement in the said case and consequently direct the 3rd respondent to pass award basing on the merits of the petition without making further reference to the respondents.
The petitioner who is a casual worker was removed from service by the second respondent. Against the said removal, the petitioner raised Industrial Dispute No.2 of 2014 before the Central Government Industrial Tribunal- cum-Labour Court, Hyderabad and the said case is pending. The grievance of the petitioner is that though the respondents are under a duty to file counter within 15 days, so far no counter has been filed and there is no progress in the said case. The petitioner seeks a direction to the Industrial Tribunal for expeditious disposal of the industrial dispute.
Having regard to the submission made by the learned counsel appearing for the petitioner, the Central Government Industrial Tribunal-cum-Labour Court, Hyderabad is directed to adjudicate the dispute within a period of four months from the date of receipt of a copy of this order.
The writ petition is disposed of accordingly at the stage of admission. There shall be no order as to costs. The Miscellaneous Petitions pending if any shall stand closed.
