THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.33361 of 2014 ORDER :
The grievance of the petitioner is that she is the owner of land to an extent of Ac.1.87 cents in Survey No.161 of Rapur Village and Mandal, in SPSR Nellore District. Out of this, Ac.1.05 cents was acquired by the Special Deputy Collector, Moolapet, SPSR Nellore District (3r d respondent) for the purpose of laying road. But no compensation was paid.
2. Learned Counsel for the petitioner submits that on 04.05.2011 the Tahsildar, Rapur (4th respondent) submitted a report to the Special Deputy Collector, Land Acquisition, Telugu Ganga Project, holding that the petitioner is the owner of the property and entitled to receive the compensation.
3. Learned Counsel for the petitioner further submits that so far the notice issued on 05.05.2014 is not replied and petitioner is suffering on account of non-payment of compensation.
4. Having regard to the submissions made, without expressing any opinion on merits, the writ petition is disposed of directing the Special Deputy Collector to consider the claim of the petitioner as reflected in the notice dated 05.05.2014 duly taking note of the report of the Tahsildar, Rapur, dated 04.05.2011 and pass appropriate orders as warranted by law. If the petitioner is found to be eligible to receive compensation, the same shall be paid without any further delay. If the Land Acquisition Officer requires any further information, the same should be communicated to the petitioner and the petitioner shall furnish the information as required by the Land Acquisition Officer, for consideration of his request. There shall be no order as to costs.
5. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
