Grievance of the petitioner is that Plot No.373, situate at Village Surirbijau Bagar, Tehsil Mant, District Mathura, which is recorded as Naveen Parti in the revenue records, was being repeatedly encroached by the villagers. Earlier when the encroachment was made by the father of the respondent no.6 an order was passed on 15.03.1991 for his eviction. Now the respondent no.6 has himself encroached the disputed land and once again encroachment proceedings under Section 67 had been initiated.
Under such circumstances, without going into the merits of the case, it is being directed that the proceedings which had been initiated being Case No.169 of 2020, Computerized No.T201901500404592 be concluded within a period of 90 days from the date of receipt of a certified copy of this order, if there is no legal impediment.
However, the court is of the view that the Gaon Sabha should be more vigilant to see that its own property is not encroached again and again.
With these observations, the writ petition is disposed of.
