IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) TUESDAY, THE TWENTY THIRD DAY OF DECEMBER TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.38516 of 2014 BETWEEN Smt.Piru Sipyai and another ... PETITIONERS AND The State of Telangana, Rep. by its Principal Secretary (Department of Revenue), A.P. Secretariat Building, Hyderabad and others.
...RESPONDENTS The Court made the following:
ORDER:
Heard.
2. By this writ petition, Petitioners complain of action of the respondents in interfering with their peaceful life and liberty and putting them to threat of life. Petitioners allege that respondent No.7 along with respondent Nos.6 and 8 visited their house and respondent No.7 searched the house making enquiries about the son of the petitioners; threatened the petitioners; beaten them and also threatened their minor daughter to disclose the whereabouts of their son. Petitioners state that they have filed a complaint before respondent No.7 on 06.12.2014 alleging that their elder son by name Tushan Sipai has suddenly disappeared from 20.11.2014 and in the meanwhile, the police officer by name Suranjan Manda, working in Garseloti Police Station, Maharashtra State, enquired about the whereabouts of the son and allegedly beaten them and have allegedly stolen the gold articles from the petitioners’ house and also threatened their minor daughter and hence, they requested to take action again the said police officer.
3. Instructions received by the learned Government Pleader from Respondent No.7 show that there was a crime registered on 30.11.2014 viz., Crime No.102/2014 for the offence punishable under Sections 363, 366, 368 r/w 34 IPC against the said son of the petitioners by name Tushan Sipai on the file of Chamori Police Station, Gadchiroli District, Maharashtrate State, on the allegation that he has kidnapped a minor daughter of the complainant therein and since then the whereabouts of the said Tushan Sipai and the minor daughter are not known and the police of Chamori Police Station have started investigation in the case and in that connection visited respondent No.7 and requested him to provide assistance. Accordingly, respondent No.7 is stated to have assisted the police of Maharashtra State by showing the address of the petitioners. Petitioners’ complaint, dated 06.12.2014 was sent by post to respondent No.7 police station and immediately an entry was made in the G.D. and after conducting appropriate preliminary enquiry, further action is proposed to be taken. It is also stated that so far as petitioners are concerned, there is no complaint or case registered against them before respondent No.7 police station and that respondent No.7 police have never interfered with the life and liberty of the petitioners.
4. Though the petitioners have impleaded the State of Telangana and respondent No.7 Police Station of Telangana, the rest of respondent Nos.2 to 6 and 8 relate to Maharashtra State. Keeping in view the allegations in the complaint, it is only respondent No.7, before whom the said complaint of petitioner is filed, and as stated in the instructions after conducting preliminary enquiry, respondent No.7 would take appropriate further action in the matter. Evidently, the petitioners are attempting to save their son, who is an accused of a serious offence, in the case referred to above and hence, at this stage, no further directions are called for.
Writ petition is, accordingly, dismissed. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
