The petitioner has filed the above Writ Petition against Ext.P3 assessment order on the ground of violation of principles of natural justice. The learned counsel for the petitioner submits that in fact, the assessee has filed an appeal and that he would rather pursue the same than invoke the extra ordinary jurisdiction of this Court. In such circumstance, without prejudice to the contentions raised, the Writ Petition is closed.
