Heard Shri Manoj Kumar, learned counsel for the petitioners, Shri Arun Kumar Srivastava, for respondent no.4 and the learned standing counsel.
This writ petition has been filed against the orders dated 22.12.2017 and 18.8.2017 cancelling the patta of the petitioners.
The findings recorded by the appellate authorities are that there was no clear notice under Rule 173 of U.P.Z.A.&L.R Rules from the date of proclamation and the date of meeting which learned counsel for the petitioners is unable to controvert, coupled with the fact that this court in Shobha Ram vs. State of U.P 2004(2)R.D 178 and Moinuddin vs Board of Revenue, U.P, Allahabad 2002(93) RD 648 has held that the conditions provided under Rule 173 are mandatory, breach thereof renders the lease as illegal.
No good ground is made out to entertain this petition.
The writ petition is dismissed.
