Learned counsel for the applicant has taken this Court very lightly. I was about to request the learned counsel for the applicant to furnish all the medical data of the applicant but he insist to refer paragraph 6 of the application.
It is nowhere stated that that he was advised a complete bed rest by the doctor who treated him. The warrant was issued on 2.5.2018 as he did not appear and now it is very clear that on 18.9.2018 he became well despite that neither he nor his advocate had approached the learned Trial Court for cancellation of non bailable warrant and that is why the learned Trial Court issued fresh non bailable warrant on 29.9.2018.
The submission that non appearance was not wilful seems to be wilful and he has taken undue advantage of his liberty.
I do not find any merit as it was not supported by any cogent reasons.
With these observations, this application being devoid of merits, cannot be entertained and is dismissed.
