Heard learned counsel for the applicants and learned AGA. This application has been filed by the applicants with a prayer to stay the further proceedings in pursuance of the order dated 23.09.2009 passed by learned ACJM, Deoria in Final Report No.64 of 2008, under sections 498A, 323, 504, 506 IPC and ¾ D.P. Act, P.S.Kotwar, District-Gorakhpur. From perusal of record, it appears that in this case final report has been submitted, the same has not been accepted by the learned Magistrate and passed order for doing further investigation. The impugned order does not suffer any illegality irregularity, the prayer for staying the proceedings is refused.
However, it is directed that during the pendency of further investigation, no coercive step shall be taken against the applicants. With this direction, this application is finally disposed of.
