Heard learned counsel for the petitioner and learned A.G.A. for the State.
The present writ petition has been filed with the following prayer:-
"(i) Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 and 3 to make fair and proper investigation in pursuance of the F.I.R. dated 03.12.2018 in Case Crime No. 890 of 2018 under Section376 I.P.C. Police Station Subhash Nagar, District Bareilly against accused/respondent no.4 to 6 (Annexure No.1 to this writ petition).
(ii) Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 to transfer the investigation from Police Station Subhash Nagar to another Police Station Bareilly."
However, when the case was taken up for admission, the Court has clearly informed that the accused Sumit Pal had filed a writ petition before this Court being Criminal Misc. Writ Petition No. 1430 of 2019, which was disposed of by order dated 21.1.2019 with the direction that till submission of police report under Section 173 (2) Cr.P.C. the petitioner in that case will not be arrested and the petitioner has now filed a present writ petition.
Looking to the facts and circumstances, the writ petition is disposed of finally with the direction that the police authority will ensure a fair and proper investigation within a period of two months from the date of the production of a certified copy of this order before the authority concerned, the investigation will be done in a very expeditious and very fairly manner.
