Heard learned counsel for the petitioner; Shri Vivek Srivastava, learned Standing Counsel for the State respondents and Shri Manoj Kumar Yadav, Advocate appearing for the fifth respondent.
Petitioner before this Court is assailing the validity of order dated 29.01.2018 passed by Deputy Collector, Sadar, Varanasi, whereby, the settlement of fair price shop in question has been made in favour of the sixth respondent.
At the very outset, learned Standing Counsel as well as Shri Manoj Kumar Yadav, Advocate raised a preliminary objection that the present writ petition has been filed with the delay and laches and the same is liable to be dismissed on this ground alone.
On such an objection, this Court has proceeded to consider the report submitted by the Stamp Reporter wherein it has been mentioned that the present writ petition has been filed with the delay of 229 days. This Court has also perused the record in question and the same does not contain any plausible reason for the delay and laches, in view of this, the writ petition cannot be entertained by this Court and the same is dismissed on the ground of delay and laches.
