1. This writ petition is filed by petitioner, who is a Member of Gaon Sabha to expedite the proceedings initiated against private respondents under Section 67 of U.P. Revenue Code, 2006.
2. It appears that though the petitioner is a Member of Gaon Sabha, the Gaon Sabha itself is not taking care of its duties prescribed under U.P. Panchayat Raj Act, 1947 and petitioner being a Member is also responsible for the negligence to carry out the duties of Gaon Sabha. The correct approach for petitioner is to take up the case at Gaon Sabha itself to take a responsible decision to pursue the above referred case before Tehsildar concerned. However, the same has not done. Even no relief can be granted to petitioner on the ground of locus also, being not a party to said proceedings.
3. However, petitioner is at liberty to take a consensus decision at the Gaon Sabha level to pursue the case before Tehsildar concerned for its expeditious disposal.
4. With aforesaid observation, the writ petition is disposed of.
