ORDER:
Petitioner questions inaction of respondents 1 to 5 in restraining encroachments in Rs.Nos.206, 208, 210 and 211 of Madivada village, Akiveedu Mandal, West Godavari District.
2. Instructions received by the learned Assistant Government Pleader state that there are no encroachments in any of the said survey numbers, as mentioned by the petitioner and the present status of the land in each survey number is described, under the instructions, stating that lands in Sy.Nos.206, 208 and 210 are Government lands and in the remarks columns it is mentioned as no encroachments. So far as Sy.No.211/1 is concerned, it is stated that it is a private land of one Motupalli Narayana Murthy, which is converted into house sites and since it is a private land, no action is warranted.
3. In view of the aforesaid instructions, therefore, the relief sought for by the petitioner is clearly based on misapprehension.
The writ petition is accordingly dismissed. As a sequel, miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
