HONOURABLE SRI JUSTICE S.RAVI KUMAR TRANSFER C.M.P.No.196 of 2013 ORDER:
This petition is filed to withdraw O.P.No.408 of 2012 from Family Court, Visakhapatnam and transfer the same to Senior Civil Judge Court, Kakinada.
Petitioner is wife and she filed her affidavit in support of the petition. According to her affidavit, her marriage was performed at Kakinada on 17-8-2005 and due to differences, she has been residing with her parents at Kakinada since 10-7-2011 along with child.
She further stated that she filed M.C.No.25 of 2012 and the same is pending before Special Mobile Court, Kakinada and she also lodged a complaint with Sarpavaram Police Station for the offence under Section 498-A I.P.C. and in both these cases, respondent is appearing and as a counter blast, he filed O.P. for restitution of conjugal rights. She further stated, taking her convenience into consideration, O.P. may be transferred from Family Court, Visakhapatnam to Kakinada.
Respondent in spite of service of notice, neither appeared in person nor through any advocate.
Heard arguments.
Considering the affidavit of the petitioner, which remained unchallenged, O.P.408 of 2012 is withdrawn from Family Court, Visakhapatnam and transferred to Senior Civil Judge Court, Kakinada for disposal in accordance with law.
Accordingly, this Transfer C.M.P. is allowed.
As a sequel to the disposal of this Transfer C.M.P., the Miscellaneous Petitions, if any, pending, shall stand dismissed.
