THE HON’BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION NO.21770 OF 2014 ORDER:
Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Labour (AP), appearing for the second respondent.
This writ petition is filed seeking to issue a writ of mandamus, declaring the action of the first respondent in not adjudicating the Industrial Dispute No.56 of 2007 pending on his file as arbitrary, illegal and unjust and consequently direct the first respondent to dispose of the matter expeditiously within a period of three weeks or as directed by this Court.
Aggrieved by the order passed against the petitioner pursuant to the domestic enquiry, he filed I.D.No.56 of 2007 under Section 2-A(2) of Industrial Disputes Act, 1947. The second respondent filed its written statement on 19-12-2007. The grievance of the petitioner is that though he is out of service for about seven years, the industrial dispute is not disposed of by the first respondent. Therefore, the petitioner seeks a direction for expeditious disposal of the industrial dispute.
In the circumstances stated by the petitioner, the first respondent is directed to dispose of I.D.No.56 of 2007 on his file as expeditiously as possible within a period not later than two months from the date of receipt of a copy of this order.
The writ petition is accordingly disposed of at the stage of admission. No order as to costs. The Miscellaneous Petitions pending if any shall stand closed.
