This writ petition, filed under Article 226 of the Constitution of India, challenges the proceedings Rc.No.767/2006 B dated 27.09.2006, issued by the second respondent/Project Director, DRDA, Visakhapatnam District as being illegal, arbitrary and contrary to G.O.Ms.No.83 dated 27.03.2006 and for a consequential direction to involve the Sarpanch of the Gram Panchayath in the disbursement under the said G.O.
2. Heard Dr.P.B.Vijaya Kumar, learned counsel for the petitioner and the learned Government Pleader for Panchayat Raj for the respondents.
3. The only grievance of the petitioner in the present writ petition is that the impugned proceedings issued by the second respondent on 27.09.2006 are contrary to the instructions of the Government in G.O.Ms.No.83 dated 27.03.2006. The petitioner herein filed the present writ petition when she was the Sarpanch of the Gram Panchayat in the year 2006.

In response to the Rule Nisi issued by this Court, counter affidavit is filed by the fourth respondent/Mandal Parishad Development Officer, Yellamanchili, Visakhapatnam district, stating that the Government issued G.O.Ms.No.24 PR&RD-(RD-II) dated 20.01.2007 in supersession of the earlier orders including G.O.Ms.No.83 dated 27.03.2006 on which the petitioner herein is placing reliance.
5. In view of the above said averment made in the counter affidavit filed by the fourth respondent/Mandal Parishad Development Officer, Yellamanchili, Visakhapatnam district, this Court does not find any necessity to interfere with the matter further.
6. For the aforesaid reasons, the writ petition is closed. As a sequel, pending miscellaneous petitions, if any, shall stand closed. No costs.
