This criminal application under Section 482 Cr.P.C. has been filed with the prayer to quash impugned charge-sheet no.111 of 2005 dated 21.12.2005 arising out of Case Crime No.531 of 2005 under Sections 147, 452, 504 I.P.C., 7 of Criminal Law Amendment Act and 171F of Representation of Peoples Act, Police Station Madhiyahun, District Jaunpur, pending in the court of Additional Chief Judicial Magistrate-I, Jaunpur.
Today, none is present on behalf of the applicants.
Perusal of record shows that after investigation charge sheet was submitted against the applicants on which cognizance was taken by the learned Magistrate concerned. From contents of the F.I.R., prima facie a cognizable offence is made out against the applicants. The Magistrate has rightly taken cognizance of the offence against the applicants.
In view of above, the application under Section 482 Cr.P.C. lacks merit. It is, accordingly, dismissed. The interim order dated 02.11.2006 is vacated.
Certify this judgment to the lower Court immediately.
