The writ petition has been filed for the following reliefs :-
"(i) issue a writ, order or direction in the nature of mandamus directing the respondents authority to consider the accidental claim of the petitioner regarding death of head of family which is pending before them within stipulated time."
Learned counsel for the petitioner has submitted that husband of the petitioner namely Raj Kumar has died in an accident and the family of the petitioner is very poor and living under below poverty line. He further submitted that the petitioner had filed a claim under Samajwadi Kisan Avam Sarvhit Beema Yojna. According to him, "Samajwadi Kisan Avam Sarvhit Beema Yojna" has now substituted as "Chief Minister Kisan Avam Sarvhit Beema Yojna". He further submitted that the claim is pending before the appropriate/concerned authority since 1.8.2018, however, no action has been taken by them till date.
Considering the facts and circumstances of the case, petitioner is directed to approach the concerned District Magistrate for redressal of her grievances and in case, petitioner moves a representation along with a certified copy of this order within one month from today, the same shall be considered and decided by the District Magistrate in accordance with law, preferably within two months from the date of receipt of the certified copy of the order of this Court.
With the above observations, the petition stands disposed of.
