The prayer made in the instant petition is for issuing direction to the trial court to decide the application for temporary injunction pending in Original Suit No. 465 of 2018 within the stipulated time and direct the parties to maintain status in the meantime.
It is pointed out that the defendant no. 1 has already entered appearance. He has also filed a written statement. As regard the other defendants, it is not clear whether they have been served or not. The trial court had declined to grant ex-parte injunction on 28.04.2018 being of the opinion that the defendants are required to be heard before the application is decided. The order dated 28.04.2018 is not under challenge.
Having regard to the above facts, the instant petition is disposed of by providing that as soon as all the defendants are duly served, the trial court shall endeavour to decide the application for temporary injunction expeditiously, by fixing short dates and without granting unnecessary adjournments to either of the parties.
