Phoola Devi vs Upper Civil Judge

High Court Of Judicature at Allahabad|27 February, 2018
|

JUDGMENT / ORDER

Court No. - 19
Case :- MATTERS UNDER ARTICLE 227 No. - 1212 of 2018 Petitioner :- Phoola Devi Respondent :- Upper Civil Judge (J.D.) Vth Jaunpur And Another Counsel for Petitioner :- Dinesh Kumar Pandey
Hon'ble Manoj Kumar Gupta,J.
The petitioner, who is defendant in Original Suit No. 718/1997 has filed the instant petition for a direction to the trial Court to decide the suit expeditiously.
A perusal of the order sheet reveals that the suit is fixed for recording of ex-parte evidence.
It is not understandable, as to why the defendant has filed the instant petition seeking its expeditious disposal when the suit is proceeding ex-parte. However, since the matter is of the year 1997, it would be in the fitness of things that the trial Court endeavours to decide the proceedings expeditiously.
With these observations, the petition stands disposed of.
