Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.
This application under Section 482 Cr.P.C. has been filed seeking direction to the court below for early decision of Criminal Case No. 3972 of 2008, arising out of Case Crime No. C-27 of 2003, under Sections 419, 420, 467, 468, 471, 120B I.P.C., Police Station- Line Bazar, District Jaunpur, pending before the Chief Judicial Magistrate, Jaunpur.
Learned counsel for the applicant submits that an application U/s 482 Cr.P.C. No. 41943 of 2013 had been filed by the opposite party no. 2/accused to challenge the prosecution. Initially an interim order was granted by this Court vide order date 21.11.2013. Subsequently, the said interim order was vacated by this Court vide order dated 11.10.2017.
Besides the fact that there is no stay order in operation in the aforesaid 482 Cr.P.C. application filed by the accused/opposite party no. 3 the trial has remained pending without framing of charges.
Considering the fact that the trial has remained pending for very long and without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid case in accordance with law, without granting any unnecessary or long adjournments to either of the parties, as expeditiously as possible, if there is no other legal impediment.
