Heard learned counsel for petitioners and A.G.A. for State of Uttar Pradesh.
This writ petition has been filed for quashing the F.I.R. dated 02.11.2018 registered as Case Crime No. 209 of 2018, under Sections 363, 323, 506 I.P.C. & 7/8 POCSO Act, Police Station- Madanpur, District Deoria.
The contention of the counsel for the petitioners is that present prosecution has been instituted with a malafide intention for the purposes of harassment.
After hearing the learned counsel for the petitioners and after perusing the averments made in the petition, the prayer for quashing F.I.R. is refused.
However, it is directed that in case the petitioners appear and surrender before the court below and apply for bail, their prayer for bail shall be considered and decided according to law.
In the result, the writ petition is disposed of finally.
