Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the State respondents and perused the record.
Present petition has been filed challenging the impugned order dated 11.7.2018 as well as order dated 5.9.2018 passed by respondent no. 2. A further prayer has been made to direct the respondents not to interfere in peaceful working of the petitioner on the post of Gram Pradhan of Gram Panchayat Pakadia Naugavan.
Learned Standing Counsel has filed personal affidavit of respondent no. 2- District Magistrate, Pilibhit annexing therewith copy of the enquiry report submitted by the duly constituted Enquiry Committee and a copy of the show cause notice dated 29.10.2018 annexed as annexure 4 issued under Rule 256 relating to Section 95(1)(g) of UP Panchayat Raj Act, 1957 and the Rules framed therein, which has already been issued to the petitioner granting him 30 days time to submit his explanation.
In such view of the matter, I do not find any good ground to keep this pending and the same is disposed of with liberty to the petitioner to file her reply to the show cause notice dated 29.10.2018 annexed as annexrue 4 to the affidavit and the authority concerned may proceed further in the matter on its own merits strictly in accordance with law.
Present petition is accordingly disposed of with the aforesaid observations/directions. No order as to costs.
