JUDGMENT / ORDER

The petitioner herein is the sole accused in C.C No.1479/2012 of the Judicial First Class Magistrate Court- Ettumanoor. Finding that the possible delay in disposal will stand in the way of his prospects for job abroad he made this application under Article 227 of the Constitution of India, for a direction to the trial court to dispose of the case within a period fixed by the court. The learned Magistrate has now reported that the prosecution has cited 8 witnesses in the case, and that a minimum period of 8 months will be required to dispose of the case. The actual pendency in the said court is not seen reported. It is also reported that an application filed by one of the accused for discharge is pending. In such a situation a time bound disposal cannot be directed by this court. However, on a consideration of the grievance of the petitioner I feel it appropriate to direct the learned Magistrate to try and dispose of the case as expeditiously as possible. In the result, this O.P (Crl.) is closed, with direction to the O.P(Crl.) No. 158 of 2014 2 court below, that C.C 1479/2012 shall be tried and disposed of as expeditiously as possible, considering the grievance of the petitioner that delay in disposal will stand in the way of his prospects for job abroad.
