The petitioner is aggrieved with the recovery of salary, initiated for default in a loan availed of by the 3rd respondent. Admittedly, the petitioner is a surety to the 3rd respondent and he has also executed an agreement under Section 37 of the Kerala Co- operative Societies Act, 1969. The contention of the petitioner is that, he is retiring on 31.12.2014 and recovery from salary may not be now effected and he has no objection in the amounts being recovered from the DCRG of the petitioner. In such circumstances, there shall be a direction to that effect and the petitioner's DCRG shall not be disbursed by the 4th respondent unless the amounts to the 1st respondent is paid. The recovery from the salary WP(C).28210/14 2 of the petitioner shall be kept in abeyance. The writ petition is disposed of.
