The petitioner filed Writ Petition No.11853 (SS) of 2018 for direction to the respondents to appoint petitioner as Assistant Teacher in Primary Education Department of State in the light of the directions issued by the Supreme Court on 25.7.2017 in Civil Appeal No.(s) 4347-4375 of 2014. The aforesaid writ petition was disposed of with direction to respondent no.3 in the writ petition to examine the claim of the petitioner with reference to the orders passed by the Supreme Court in the matter. It was further directed that the required action must be taken by the Board within a period of two months from the date of presentation of certified copy of the order of the Writ Court.
In pursuance to the notice issued in this contempt petition, a compliance affidavit of Ms. Ruby Singh, Secretary, U.P. Basic Shiksha Parishad, Prayagraj has been filed. Along with the aforesaid affidavit, a copy of the decision dated 2.8.2019 has been placed on record as Annexure No.A-1. From perusal of the aforesaid order, it is evident that Contempt Petition No.1391-1419 of 2018 is pending before the Supreme Court and the petitioner's case would be subject to the final outcome of the aforesaid contempt petition.
In view of the aforesaid decision dated 2.8.2019 taken in the case of the petitioner, nothing survives in the present contempt petition, which is hereby disposed of as having become infructuous with liberty to the petitioner to approach this Court again after disposal of the aforesaid contempt petition no.1391-1419 of 2018 by the Supreme Court favouring the petitioner..
Contempt notice stands discharged.
