M/S Petroland Agencies vs Bharat Petroleum Corporation ...

High Court Of Kerala|25 February, 2000

JUDGMENT / ORDER

Learned Counsel for the petitioner submits that eventhough the relief to the extent of quashing Exts.P2, P4, P5 and P10 is sought for in this writ petition, the petitioner will be satisfied with a direction issued to the 2nd respondent to consider Ext.P17 and to take an appropriate decision with respect to the request for commencement of the retailing activity in the new premise of the petitioner. This especially because of expiry of the period of the contract, at present.
2. Considering the facts and circumstances, this court is inclined to grant the relief as mentioned above. Therefore the writ petition is disposed of by directing the 2nd respondent to consider Ext.P17 and to take an appropriate decision with respect to the request made thereon, after affording opportunity of personal hearing to the petitioner, at the earliest possible, at any rate within a period of two months from the date of receipt of a copy of this judgment.
C.K.ABDUL REHIM, JUDGE.
