~ ~ ~ ~ ~ ~ Petition filed under Section 439 Cr.P.C. 2. Petitioners are accused Nos.3 and 4 in crime No.1543/2014 of Kollam East Police Station registered for the offences punishable under Section 20(b)(ii)B of the NDPS Act.
3. The allegation against the petitioners is that, on 04.08.2014 at 3.30 p.m., they, along with accused Nos.1 and 2, were found standing at Karbala junction, Kollam and it was seen that accused Nos.1 and 2 were handing over bags containing a total quantity of 13.530 Kgs of ganja to the petitioners.
4. Heard learned counsel for the petitioners and the learned Public Prosecutor. The learned Public Prosecutor has opposed the petition. It has been pointed out that some BA.7263/2014 : 2 :
criminal antecedents are there on the part of the 2nd petitioner herein. The quantity of ganja involved is 13.530 Kgs. They were arrested while they were receiving that quantity of ganja from accused Nos.1 and 2, who have serious criminal antecedents. Considering the seriousness of the offences involved, this Court is of the view that they are not entitled to be enlarged on bail.
In the result, this Bail Application is dismissed.
