(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) Learned advocate Mr.Devang Nanavati appearing with Mr.Shivang M. Shah for the petitioners files affidavit in rejoinder. The same is taken on record.
The learned advocate for the petitioners brought to the notice of the Court that the Government has issued notices under subsection (3) of section 12 of the Land Acquisition Act to various parties. Some of them have approached this Court by filing Special Civil Application No.5738 of 2012, wherein this Court (Coram: D.H. Waghela & Mohinder Pal, JJ.) has passed order on 19th April 2012, which reads as under:
"RULE returnable on 14.06.2012. Learned A.G.P. waives service for respondent No.1. Direct service for the rest. In the meantime, ad-interim relief in terms of para 11 (C)."
2. The learned advocate submitted that, that being so, it will be in fitness of things if these matters are heard by one Bench, so as to avoid the possibility two Benches taking different view in similar matters.
The learned AGP has no instruction in this regard.
3. The Registry is directed to place the aforesaid facts before the Hon'ble the Acting Chief Justice to pass appropriate orders of placing both the matters before the same Bench.
