ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus directing the 2nd respondent not to suspend the petitioner permanently.
Heard the learned counsel appearing for the petitioner and the learned Government Pleader appearing for the respondents 1 to 4 and the learned counsel appearing for the 5th respondent.
The petitioner is the Field Assistant and she was appointed by the 5th respondent vide orders dated 14.03.2006. Basing on a complaint made by the villagers, she was placed under suspension and charge sheet was issued. Now the enquiry is in progress.
It is submitted by the learned counsel appearing for the petitioner that the petitioner did not commit any irregularity and basing on the complaint made by her rivals, she was placed under suspension and the enquiry was initiated. The petitioner seeks to revoke the suspension order.
Since the enquiry is in progress and the suspension order is based on specific allegations, I am not inclined to revoke the suspension. However, the respondents are directed to complete the enquiry and pass final orders, within a period of 2 (two) months from the date of receipt of a copy of this order.
The Writ Petition is accordingly disposed of. There shall be no order as to costs.
Pending miscellaneous petitions, if any, shall stand closed in consequence.
