This Civil Miscellaneous Appeal has filed against the judgment and decree passed in M.A.C.T.O.P.No.994 of 1993 on the file of Second Additional Sub-Court (Motor Accidents Claims Tribunal) at Madurai, dated 23.06.2003.
2. When the matter was taken up for hearing on 26.10.2017, there was no representation on behalf of the appellant as well as the respondents. Hence, the matter has been adjourned to 30.10.2017, under the caption ?For Dismissal? and on 30.10.2017, when the matter was taken up for hearing, the learned counsel for the third respondent appeared before this Court and seeks time and there was no representation on behalf of the appellant. Hence, the matter was adjourned to 07.11.2017. On that day, the case has not been reached, then it was posted on 08.11.2017.
3. Even today (i.e on 08.11.2017), there is no representation on behalf of the appellant. Hence, this Civil Miscellaneous Appeal is dismissed for non-prosecution. No costs.
