Respondents (By Sri Y.D.Harsha, AGA) These Writ Petitions are filed under Articles 226 and 227 of the Constitution of India praying to direct the R-2 to forthwith honour the bills submitted by the P-1 amounting to Rs.6,54,392 P-2 amounting to Rs.32,59,477/- P-3 amounting to Rs.1,05,17,284/- and P-4 amounting to Rs.4,06,800/- institutions in full, for having imparted MES training to the candidates. Direct the R-2 authority to give interest at the rate of 12% per annum, from the date of failure to honour the bill i.e 30 days from the submission of the respective bills.
These Writ Petitions Coming On For Orders, This Day, The Court Made The Following:
O R D E R Mr. Krishna S.Vyas, learned Counsel for the petitioners.
Mr. Y.D.Harsha, learned Additional Government Advocate for the respondents.
The petitions are admitted for hearing. With the consent of learned Counsel for the parties, the matters are heard finally.
2. In these writ petitions, petitioners are aggrieved by the inaction of the respondents in not honouring the bills of the petitioners for having imparted Modular Employable Skills training to the candidates.
3. When the matter was taken up today, learned counsel for the petitioners submitted that the petitioners have submitted bills to the competent authority to the tune of Rs.6,54,392/-, Rs.32,59,477/-, Rs.1,05,17,284/- and Rs.4,06,800/-, respectively, on account of having imparted Modular Employable Skills training to the candidates. It is also submitted that the controversy involved in these petitions is squarely covered by the order dated 30.01.2018 passed in W.P.Nos.58780/2016 and connected petitions.
4. The aforesaid submission has not been opposed by learned Additional Government Advocate.
5. In view of the submissions made and in the facts of the case, the writ petitions are disposed of with the following direction:
“ 8. Therefore, a direction is issued to respondent No.2 to take note of the bills as submitted by the petitioners and reconcile the same with the list of candidates as submitted by the petitioners and the list available with the respondents if any and in respect of the candidates where there is no dispute, the amount shall be quantified and the same shall be paid to the petitioners. The process of reconciliation shall be completed within a period of six weeks from the date of receipt of a copy of this order. The payment due and payable shall be paid to the petitioners within a further period of three months from the said date.”
It is made clear that this court has not expressed any opinion with regard to the merits of the claim of the petitioners.
Accordingly, the petitions are disposed of.
