JUDGMENT / ORDER

Petition under Section 438 of CR.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to grant Anticipatory Bail to the petitioners by directing the police to release them on bail in the event of their arrest in connection with Crime NO. 66 of 2014 of Eluru II Town Police Station in the interests of justice.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein, and upon hearing the arguments of Sri Nimmagadda Satyanarayana, Advocate for the Petitioners and of the Additional Public Prosecutor on behalf of Respondent-State, the Court made the following.
ORDER:-
“The petitioners seek for grant of anticipatory bail. They are accused 1 and 4. The learned counsel for the petitioners submitted that after filing of the application, accused No.1 had been arrested. This petition has become infructuous so far as accused No.1 is concerned and is accordingly dismissed.
2. The 2nd petitioner, who is accused No.4, is a lady. She along with accused No.1 allegedly committed the offences under Sections 354, 323 and 506 read with Section 34 IPC. In view of the fact that the 2nd petitioner/accused No.4 is a lady and in view of the nature of the offences alleged against her, I consider it appropriate to enlarge her on anticipatory bail.
3. Consequently, this petition is allowed so far as the 2nd petitioner/accused No.4 is concerned.
The 2nd petitioner/accused No.4 shall surrender before the II Additional Judicial Magistrate of First Class, Eluru, West Godavari District within 2 (two) weeks from today. On such surrender, the learned II Additional Judicial Magistrate of First Class, Eluru shall release her on bail on a bond of Rs.10,000/- (Rupees ten thousand only) with two sureties in a like sum to his satisfaction.
4. Accordingly, this petition is allowed in part.”
