HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY WRIT PETITION No.32660 of 2014 Date:30.10.2014 Between:
Pentaparhi Surender Reddy, S/o P.Chandra Reddy And:
The Telangana State Power Distribution Company Limited, Hyderabad and three others.
. Petitioner . Respondents Counsel for the Petitioner: Sri Prakash Chakravarthy Counsel for the Respondents: Sri O.Manoher Reddy The Court made the following:
ORDER:
This Writ Petition is filed for a Mandamus to declare the action of the respondents in leying the bill three times to its original bill in relation to the petitioner’s Service Connection as illegal and arbitrary.
At the hearing, Sri Prakash Chakravarthy, learned counsel for the petitioner, has not disputed that under Section 42(5) of the Electricity Act, 2003, (for short ‘the Act’), a consumer aggrieved by the action of the licensee is entitled to seek redressal of his grievance before the Consumer Grievance Redressal Forum and that a further remedy by way of approaching the Ombudsman under Section 42(6) of the Act is also available.
In view of availability of these remedies, I am not inclined to entertain the Writ Petition for adjudication on merits.
The Writ Petition is, accordingly, disposed of with liberty to the petitioner to avail the above-noted remedies.
As a sequel to disposal of the Writ Petition, W.P.M.P.No.40824 of 2014 filed by the petitioner for interim relief stands disposed of as infructuous.
