The petitioners are A.1 to A.5. They seek for quashment of the First Information Report in Crime No.266 of 2013 of Kovvur Town Police, West Godavari District.
The offences alleged against the petitioners are under Sections 389, 451, 354 (i), 292 and 506 read with Sections 109 and 34 of the Indian Penal Code.
The offences are considerably serious in nature. It would be appropriate to permit police to continue the investigation. However, as it is contended that a case was falsely foisted against the petitioners, it would be appropriate to restrain the police from arresting the petitioners.
Consequently, the Criminal Petition is disposed of granting liberty to police to proceed with the investigation. Police, however, are restrained from arresting the petitioners till completion of the investigation. Miscellaneous Petitions, if any pending in this Criminal Petition, shall stand closed.
