THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.35121 of 2013 ORDER :
The petitioner is selected to establish the retail outlet dealership of BPCL, Chinna Raman Cherla Village, Bachannapet Mandal, Warangal District. Along with the application, the petitioner has submitted registered lease deed dated 20.06.2012. The registered lease deed described location of the land under which he proposed to instal in Survey No.181 of Chinna Raman Cherla Village. The petitioner was granted letter of intent dated 08.01.2013 and NOC certificates were issued from the authorities concerned. However, on an inspection by the RDO, it was found that the area where the outlet is proposed to be installed is not located in Survey No.181 but was located in Survey No.177. This discrepancy was informed to the petitioner vide memo in March, 2013. The petitioner noticed that the mistake occurred due to typographical error and he took steps to rectify the lease deed and accordingly, rectification deed was registered showing the correct Survey number as 177. After taking proper steps, the petitioner applied on 09.11.2013 to consider the rectification deed and permit him to establish retail outlet since letter of intent was already granted on 08.01.2013.
2. Learned counsel for the petitioner submits that so far, no orders are passed on the representation and the writ petition may be disposed of directing the respondent corporation to pass orders on the representation submitted by the petitioner.
3. Having regard to the submissions made, without expressing any opinion on merits, this Writ Petition is disposed of directing the 2nd respondent Corporation to consider the representation submitted by the petitioner on 09.11.2013 and pass appropriate orders as warranted by law and communicate the same to the petitioner within a period of four weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
