JUDGMENT / ORDER

Petitioner apprehends arrest by the Thalassary police and has filed this application.
2. Learned counsel submits that the petitioner filed S.T.No.1181 of 2013 in the Judicial First Class Magistrate's Court, Thalassery against one Jayarajan under Sec.138 of the Negotiable Instruments Act. He, in turn preferred complaint to the police alleging that the petitioner is engaged in money lending business. It is submitted that the petitioner is not engaged in any such business.
3. Learned Public Prosecutor has submitted that information received by the police is that the petitioner is engaged in money lending. Though a search was conducted in the premises of the petitioner, nothing incriminating could be seized. No case is registered against the petitioner as stated in the report dated 01.06.2014 of the S.H.O, Thalassery.
4. In the circumstance, petitioner cannot have any apprehension of arrest now. It is directed that in case interrogation of the petitioner is required in connection with the complaint, the B.A.No.3920 of 2014 2 police shall serve notice on the petitioner under Sec.41A of the Code of Criminal Procedure.
With the above direction the application is closed.
