JUDGMENT / ORDER

The petitioner challenges the purchase of a property by the respondent Society. The petitioner is a member of the Bank who has filed a petition dated 03.03.2013 before the Joint Registrar for looking into the malpractices, alleged in the purchase of the property. However, though notice was issued to the petitioner, it is stated that before such notice was received, the matter was disposed of by Ext.P2. 2. I have heard the learned counsel appearing for the respondent Bank also.
3. The only prayer of the petitioner is that he may be heard before disposal of his petition. In such circumstances, Ext.P2 shall WP(C).30905/13 2 stand set aside. It is made clear that, this Court has not looked into the merits of the matter and has merely set aside Ext.P2 to facilitate re-consideration of the application filed. The petitioner and the respondent Bank shall appear before the Joint Registrar on 09.12.2014 on which date, the matter shall be considered and orders passed within a month thereafter. If the petitioner does not appear on 09.12.2014, the matter shall stand rejected.
The writ petition is disposed of, leaving the parties to suffer their respective costs.
