The petitioner is the holder of quarrying permit. The petitioner wants to remove top soil from the quarrying area. The petitioner relies on Ext.P2 judgment.
In Ext.P2 judgment, it is held that the Geologist cannot insist the petitioner to fill the pit by using top soil. Therefore, necessary 'P form' shall be issued to the petitioner after ascertaining the quantity without insisting for No Objection Certificate and Environmental Clearance. Needful shall be done within a period of two weeks from the date of receipt of a copy of this judgment.
The writ petition is disposed of as above.
