The petitioner has approached the Tahsildar for issuance of patta in respect of property in Survey No.59 in Kottayam Municipality. The Tahsildar, it seems have rejected stating that this is located in thodu puramboke and therefore that cannot be assigned. This is seen from Ext.R3 (a) produced along with the statement filed by the 3rd respondent. The petitioner stated that this property can be assigned and there is no impediment for assigning this piece of land. Considering the fact that this land is situated in Municipal area, the petitioner shall approach the District Collector, Kottayam for assignment of land with fresh application. The District Collector shall after adverting to the factual situation find out whether this land can be assigned to the petitioner and to take appropriate action WP(C).No.24316/2013-L.
2 within two months from the date of receipt of such application.
Writ petition is disposed of as above.
