Heard Sri Om Prakash Singh, learned counsel for the petitioner and Sri Mithlesh Kumar, learned A.G.A. for the State.
The relief sought in the writ petition is to the following effect:-
".......allow the application, direct the opposite party no.1/District Magistrate, Sant Kabir Nagar, to decide the application dated 02.11.2018, moved by the application in case bearing No. D20181765000125, under Section 14(1) of Gangsters and Anti-Social Activities (Prevention) Act, 1986 (Stte Vs. Dinesh Tiwari), within a stipulated period."
Looking to the limited prayer, as aforesaid, we disposed of the writ petition with the direction that in case the respondent no.1/District Magistrate, Sant Kabir Nagar, has not decided the earlier application of the petitioner dated 02.11.2018, which has been annexed as annexure no.6 to the writ petition, the same shall be heard and disposed of finally, by means of a reasoned and speaking order, within a period of two months, from the date of production of certified copy of this order alongwith copy of the present writ petition before the respondent no.1/District Magistrate, Sant Kabir Nagar.
However, in case the said application has already been heard and disposed of finally by the respondent no.1/District Magistrate, Sant Kabir Nagar, this order will not be given effect to.
With the aforesaid observations, the instant writ petition is finally disposed of.
