Heard learned counsel for the petitioner; Shri Avneesh Tripathi, learned counsel for the University-respondents no. 2 & 3 and learned Standing Counsel for the State-respondent no. 1.
The petitioner claims himself to be a Class-III employee of Chaudhary Charan Singh University, Meerut. He was placed under suspension on 17.3.2018. It is submitted that departmental inquiry was conducted and the inquiry report dated 28.1.2019 (filed as Annexure 7 to the writ petition) exonerates the petitioner of the charges of misconduct along with one Salek Chand, but the petitioner has not been reinstated so far.
The writ petition is disposed of with the observation that in case the petitioner has been exonerated of the charges pursuant to inquiry report dated 28.1.2019, the Vice Chancellor may consider the claim of the petitioner for reinstatement along with allowing him other dues, if there is no other legal impediment. The Vice Chancellor is requested to take the decision on the claim of the petitioner within a period of three months from the date a certified copy of this order is presented before it.
